Rules for buying and selling goods in the online shop www.veidrodisplius.lt:

  1. General provisions

1.1. These Terms and Conditions of Sale and Purchase of Goods (hereinafter referred to as the “Terms and Conditions”), once approved by the Buyer (by familiarising himself with the Terms and Conditions and by ticking the box next to the statement “I have read and accept the Terms and Conditions of www.veidrodisplius.lt”), shall constitute a binding legal document for the parties, which shall set out the rights and obligations of the Buyer and the Seller, the conditions of purchase of the goods and the conditions of payment for the goods, the procedure for delivery and return of the goods, the liability of the parties and other provisions relating to the purchase of the goods in the www.veidrodisplius.lt online shop.

1.2. The Seller reserves the right to change, amend or supplement the Terms and Conditions at any time, taking into account the statutory requirements. The Buyer will be informed of any changes, amendments or additions at the time of logging in to www.veidrodisplius.lt and will be required to re-confirm the amended Terms and Conditions in order to shop on this online shop.

1.3. The online shop www.veidrodisplius.lt is sold only in the territory of the Republic of Lithuania.

1.4. You have the right to:

1.4.1. natural persons with legal capacity, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court;

1.4.2. minors aged between 14 and 18, with the consent of their parents or guardians, unless they are independent in the use of their income;

1.4.3. legal persons;

1.4.4. authorised representatives of all the above.

1.5. By accepting the Terms and Conditions, the Buyer confirms that, on the basis of the Terms and Conditions, he/she has the right to purchase goods from www.veidrodisplius.lt online shop.

  1. Protection of personal data

2.1. There are two ways for the Customer to order goods from www.veidrodisplius.lt:

2.1.1. by registering on this website with your username and password;

2.1.2. without registering on this website.

2.2. When ordering goods, the Buyer shall indicate in the relevant information fields provided by the Seller the personal data necessary for the proper execution of the order: name, surname, delivery address, telephone number and e-mail address.

2.3. By accepting these Terms and Conditions, the Customer agrees to the processing of his/her personal data for the purpose of selling goods and services in the electronic shop www.veidrodisplius.lt.

2.4. By consenting to the processing of his/her personal data for the purpose of the sale of goods and services in the Seller’s online shop, the Buyer also consents to the sending of information messages to the e-mail address and telephone number provided by him/her, which are necessary for the fulfilment of the order of goods.

2.5. By placing an order or registering, the customer may give his/her consent/non-consent to the use of his/her personal data for direct marketing purposes. He/she does so by ticking (I agree to the use of my personal data for direct marketing purposes) or not ticking (I do not agree). We send a monthly newsletter to the email address provided by the customer and give the customer the opportunity to unsubscribe from the newsletter (at the end of the newsletter, there is an option to “unsubscribe” – by clicking on this option, the customer will no longer receive the newsletter).

2.6. The Seller confirms that the personal data provided by the Buyer will be processed only for the purposes of selling goods and services in the online store www.veidrodisplius.lt, analysis of the Seller’s activities and direct marketing (unless the Buyer refuses the processing of his/her personal data for the purposes of direct marketing). The Seller undertakes not to disclose the Buyer’s personal data to third parties other than the Seller’s partners providing delivery or other services related to the proper execution of the Buyer’s order. In all other cases, the Buyer’s personal data may be disclosed to third parties only in accordance with the procedure provided for by the legislation of the Republic of Lithuania.

2.7. A Customer who wishes to order services from partners offered by the Seller’s online shop may do so by consenting to the transfer of his/her personal data, as explicitly stated, to the relevant partner for the purpose of providing the services ordered.

  1. The moment of conclusion of the sale and purchase agreement

3.1. The contract between the Buyer and the Seller shall be deemed to be concluded from the moment when the Buyer, having selected the product(s) to be purchased and having formed a shopping cart, clicks on the “Order” link and when the Seller, after having contacted the Buyer by telephone or by e-mail, confirms the order by sending an e-mail confirming the order.

3.2. Each contract of sale concluded between the Buyer and the Seller shall be registered and stored in the database of www.veidrodisplius.lt.

  1. Buyer’s rights

4.1. The Buyer shall have the right to purchase goods in the www.veidrodisplius.lt online shop in accordance with the procedures set out in these Terms and Conditions and in the other information sections of the Seller’s online shop.

4.2. The Buyer has the right to access his/her personal data and the right to request the correction of incorrect, incomplete or inaccurate personal data by sending an email to info@prosvp.lt or calling +370 67 22 22 4 22. In this case, the Seller must immediately comply with the Buyer’s request (within 1-2 days).

4.3. The Buyer has the right to withdraw from the contract of sale and purchase of goods concluded with the www.veidrodisplius.lt online store by notifying the Seller in writing (by e-mail, indicating the product to be returned and its order number) no later than 7 calendar days from the date of delivery of the item.

4.4. The buyer’s right to withdraw from a contract for the sale of goods shall be exercised in accordance with the Rules on the Sale of Goods and the Provision of Services when Contracts are Concluded by Means of Communication, approved by Order of the Minister of the Economy of 17 August 2001 No 258.

4.5. The buyer can only exercise the right of withdrawal if the goods have not been damaged or substantially altered in appearance, have not been used, have not been lost, have not been disassembled, and remain in their original packaging.

4.6. In the event that the Buyer purchases a set of goods in the www.veidrodisplius.lt online shop and wishes to withdraw from the contract of sale in respect of the particular item(s), the Buyer must return the entire set of goods to the Seller. In the event that any of the items in the set does not meet the requirements set out in Clause 11.4 of the Regulations, the Seller shall be entitled to refuse to accept the returned set of goods.

  1. Obligations of the buyer

5.1. The Buyer shall pay for and accept the Goods in accordance with these Conditions.

5.2. Once registered, the Buyer undertakes not to disclose his/her login details to third parties. If the Buyer loses his/her login data, he/she must immediately inform the Seller by the means of contact indicated in the “Contact” section.

5.3. If the data provided by the registered Buyer on the registration form changes, the registered Buyer must update it immediately.

5.4. By using the www.veidrodisplius.lt online shop, the Buyer undertakes to comply with these Terms and Conditions, the other terms and conditions expressly stated in the online shop, and not to violate the legislation of the Republic of Lithuania.

  1. Seller’s rights

6.1. The Seller shall have the right, at its sole discretion, to determine the minimum basket size, i.e. the minimum amount at which the Buyer’s order will be filled. This amount is visible when viewing the shopping cart.

6.2. If the Buyer attempts to undermine the stability and security of the online shop or violates his/her obligations, the Seller shall have the right to restrict or suspend the Buyer’s access to the online shop or, in exceptional cases, to cancel the Buyer’s registration, immediately and without warning.

6.3. In important circumstances, the Seller may temporarily or permanently discontinue the operation of the Online Shop without prior notice to the Buyer.

6.4. The Seller shall have the right to cancel the Buyer’s order without prior notice to the Buyer if the Buyer, having opted for payment by bank transfer, fails to pay for the Goods within 3 (three) working days.

6.5. Where the Buyer chooses to pay in cash at the time of delivery of the goods, the Seller shall contact the Buyer by the telephone number specified in the order in the event of any uncertainty about the information provided in the order. In such case, the delivery period shall commence from the date of contact with the Buyer. The Seller shall have the right to cancel the Buyer’s order without prior notice to the Buyer if the Seller is unable to contact the Buyer within 3 (three) working days.

  1. Obligations of the Seller

7.1. The Seller undertakes to provide the Buyer with access to the services of the online shop www.veidrodisplius.lt under the terms and conditions set out in these Terms and Conditions and in the Online Shop.

7.2. The Seller undertakes to respect the Buyer’s right to privacy of his/her personal information, i.e. to process the personal data specified by the Buyer only in accordance with the procedure set out in Section 2 of the Rules and the legislation of the Republic of Lithuania.

7.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer in accordance with the conditions set out in Section 9 of the Conditions.

7.4. If the Seller is unable to deliver the goods ordered to the Buyer due to important circumstances, the Seller undertakes to offer an analogous or, as far as possible, similar product. If the Buyer refuses to accept an analogous or most similar product, the Seller undertakes to refund the money paid by the Buyer within 7 (seven) working days, if prepayment has been made.

7.5. If the Buyer exercises the right provided for in Clause 4.2 of the Terms and Conditions and the condition provided for in Clause 4.4 of the Terms and Conditions, the Seller undertakes to refund the Buyer the money paid within 10 (ten) working days from the date of receipt of the returned goods.

  1. Prices, payment procedures and terms

8.1. The prices of the products in the online shop and in the order form are quoted in euros including VAT.

8.2. The buyer pays for the goods in one of the following ways:

8.2.1. Payment by bank transfer is a payment where the Buyer, after confirmation of the order, transfers the money to the bank account of www.veidrodisplius.lt after receiving a payment instruction.

8.2.2. Payment in cash on delivery/collection – the Buyer shall pay for the goods on delivery/collection (handover – acceptance).

  1. Delivery of goods

9.1. When ordering the Goods, the Buyer may choose the method of delivery of the Goods, i.e. using the Seller’s delivery service or at the Seller’s collection point.

9.2. Delivery of goods to the Buyer:

9.2.1. The Buyer undertakes to specify the exact place of delivery of the goods by selecting the delivery service at the time of ordering.

9.2.2. The Buyer undertakes to accept the goods himself. In the event that the Buyer is unable to take delivery of the goods himself and the goods have been delivered to the address indicated and on the basis of other data provided by the Buyer, the Buyer shall not be entitled to make any claim against the Seller in respect of the delivery of the goods to the wrong entity.

9.2.3. Goods shall be delivered by the Seller or its authorised representative.

9.2.4. Delivery (transport) of goods within the territory of the Republic of Lithuania is carried out with the company’s road transport or parcel services, for an additional fee.

9.2.5. Products are delivered within the territory of the Republic of Lithuania and EU countries.

9.2.6. Goods are not deposited.

9.3. Collection of goods from the Seller’s collection points:

9.3.1. The Buyer may collect the goods free of charge from the Seller’s collection point located at Kalvarijų g. 151 , Vilnius. The time should be arranged by phone +37060560046

9.3.2. Ordered goods must be collected no later than within 3 (three) working days from the moment of receipt of the Seller’s confirmation that the order is ready.

9.3.3. Goods can only be collected by the person who placed the order or the person specified at the time the order was placed. When collecting the goods, it is necessary to carry and present to the Seller’s employee a valid identity document (ID card, passport or a new driver’s licence).

9.6. The Seller shall deliver the Goods to the Buyer in accordance with the terms set out in the descriptions of the Goods. These time limits are provisional and do not apply in cases where the Seller does not have the goods in stock and the Buyer is informed of a shortage of the goods ordered. The Buyer also agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller’s control. In such case, the Seller undertakes to contact the Buyer immediately to agree on the terms of delivery.

9.7. In all cases, the Seller shall be exempt from liability for breach of the time limits for delivery of the goods if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Buyer’s control.

9.8. At the time of delivery of the Goods to the Buyer, the Buyer shall inspect the condition of the consignment and the Good(s) together with the Seller or its authorised representative and shall sign the consignment handover and acceptance document or the VAT invoice. Once the Buyer has signed the handover document or the VAT invoice, the consignment shall be deemed to have been handed over in good condition, and there shall be no damage to the goods attributable to defects other than manufacturing defects and no inconsistencies in the composition of the goods (such as can be detected by an external inspection of the goods). If the Buyer notices that the packaging of the delivered consignment is damaged (crumpled, wet or otherwise externally damaged), that the item(s) are damaged and/or that the item(s) are not in the right condition, the Buyer shall note this on the handover document or on the VAT invoice, and, in the presence of the Seller or his representative, shall draw up a free-form certificate of the damage/mismatch of the consignment and/or the item(s). If the Buyer fails to do so, the Seller shall be exempt from liability to the Buyer in respect of any damage to the goods, provided that such damage is not due to a manufacturing defect, and in respect of any inconsistencies in the assembly of the goods, provided that such inconsistencies can be ascertained from an external inspection of the goods.

  1. Guarantee of the quality of the goods and their shelf life

10.1. The characteristics of each item sold on www.veidrodisplius.lt are generally set out in the description of each item.

10.2. The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the online shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the display used by the Buyer.

10.3. The seller warrants the goods and each product has a separate warranty period, which is stated on each product.

10.4. In the event that the Seller does not guarantee the quality of the goods for certain types of goods, the warranty provided for in the relevant legislation shall apply.

10.5. The Seller shall provide after-sales service for the goods through an intermediary between the Buyer and the manufacturer or the manufacturer’s representative.

10.6. The Seller undertakes to provide after-sales service within 15-45 working days.

  1. Returning and exchanging goods

11.1. The defects of the goods sold shall be eliminated, the defective goods shall be replaced and returned in accordance with the Rules for the Return and Replacement of Goods approved by the Order of the Minister of Economy No 217 of 29 June 2001 “On the Approval of the Rules for the Return and Replacement of Goods”.

11.2. In order to return the product(s) in the cases referred to in Clause 11.1 of the Terms and Conditions, the Buyer must inform the Seller by e-mail info@veidrodisplius.lt.

11.3. The following conditions must be observed when returning goods to the buyer:

11.3.1. the returned product must be in its original packaging in good condition (this does not apply if you are returning a faulty product);

11.3.2. the goods must be in good condition (changes to the appearance of the goods or their packaging that were necessary to inspect the goods cannot be considered as material changes to the appearance of the goods);

11.3.3. the product must be unused and in good condition (no damaged labels, no torn protective film, etc.) (this does not apply if you are returning a low-quality product);

11.3.4. the returned goods must be in the same condition as when received by the Buyer;

11.3.5. When returning an item, you must present the proof of purchase.

11.4. The Seller shall have the right not to accept the Buyer’s returns if the Buyer does not comply with the return procedure set out in this Article.

11.5. The Buyer may deliver the returned goods himself to Kalvarijų g. 151, Vilnius. The time should be arranged by phone +370 60560046. In the event that the Seller does not have similar goods, the Seller shall refund the money paid for the item(s) to the Buyer.

11.6. Returns and exchanges of goods shall be carried out in accordance with the ‘Rules on Returns and Exchanges of Goods’, approved by Order No 217 of the Minister of the Economy of 29 June 2001, and the ‘Rules on the Sale of Goods and the Provision of Services in the case of Contracts Concluded by Means of Communication’ approved by Order No 258 of the Minister of the Economy of 17 August 2001.

11.7. In all cases, money for returned goods is paid by bank transfer and only to the payer’s bank account.

  1. Responsibility

12.1. The Buyer is fully responsible for the accuracy of the personal data he/she provides. If the Buyer fails to provide accurate personal data, the Seller shall not be liable for the consequences arising therefrom and shall be entitled to claim direct damages from the Buyer.

12.2. The Buyer is responsible for the actions taken when using this online shop.

12.3. Once registered, the Buyer is responsible for the transmission of his/her login data to third parties. If the services provided by www.prosp.lt are used by a third party who has logged into the online shop using the Buyer’s login data, the Seller shall consider this person as the Buyer.

12.4. The Seller shall be exempt from any liability where the loss is caused by the Buyer’s failure to read these Terms and Conditions, despite the Seller’s advice and obligations, when given the opportunity to do so.

12.5. If the Seller’s online shop contains links to the websites of other companies, institutions, organisations or persons, the Seller is not responsible for the information or activities contained therein and does not maintain, control or represent such companies and persons.

12.6. In the event of damage, the party at fault shall compensate the other party for direct damages.

12.7. The Seller shall not be liable for the proper performance of obligations between the Buyer and the Seller’s partners whose services the Buyer orders.

  1. Exchange of information

13.1. The Seller shall send all notices in accordance with the procedure set out in Clause 2.2 of the Rules to the e-mail address provided by the Buyer.

13.2. The Buyer shall send all notifications and questions to the means of contact indicated in the “Contact” section of the Seller’s online shop.

  1. Final provisions

14.1. These Rules are drawn up in accordance with the legislation of the Republic of Lithuania.

14.2. Relationships arising under these rules are governed by the law of the Republic of Lithuania.

14.3. Any disagreements arising from the application of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedures established by the laws of the Republic of Lithuania.
